Welcome to HyperLink Inc. ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website, online store, and related services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our Services. By using our Services, you represent that you meet these requirements.

2. Use of Our Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not:

  • Use our Services for fraudulent or unauthorized purposes.

  • Interfere with or disrupt the security, integrity, or performance of our Services.

  • Attempt to gain unauthorized access to our systems or accounts.

3. Products & Orders

Product Information:
We make every effort to display product details accurately. However, we do not warrant that product descriptions, images, or pricing are error-free.

Order Acceptance:
We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

Pricing & Payment:
All prices are listed in CAD unless otherwise stated. Payment is required at the time of purchase.

4. Shipping & Delivery

Shipping times are estimates and may vary depending on location and circumstances beyond our control.
Customers are responsible for providing accurate shipping information. We are not liable for orders shipped to incorrect addresses entered by the customer.

5. Returns & Refunds

Please refer to our Return Policy for details on returns, exchanges, and refunds.

6. Intellectual Property

All content on our website, including text, graphics, logos, and product images, is the property of HyperLink Inc. or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or distribute any content without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, HyperLink Inc. shall not be liable for any damages arising from your use of our Services or products, including but not limited to indirect, incidental, or consequential damages.

8. Disclaimer of Warranties

Our Services and products are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of our Services or products.

9. Indemnification

You agree to indemnify, defend, and hold harmless HyperLink Inc., its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or misuse of our Services.

10. Governing Law

These Terms shall be governed by and construed under the laws of Alberta, Canada, without regard to conflict-of-law principles.

11. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Continued use of our Services after changes are posted constitutes acceptance of those changes.

12. Starlink Mini Rental Agreement – Terms & Conditions

These rental terms apply only to customers renting Starlink Mini equipment from HyperLink Inc. By placing a rental order, accepting delivery, or using the Equipment, the Lessee agrees to the following terms:

12.1 Rental Term

The rental term begins on the date the Equipment is delivered (“Start Date”) and ends when HyperLink Inc. receives the Equipment back in good working condition unless terminated or extended under this Agreement.

12.2 Start Date

The Start Date must be at least 2 business days before your departure to avoid delays. HyperLink Inc. does not deliver Equipment on weekends or holidays.

12.3 Payment and Security Deposit

  • All rental fees must be paid in full at checkout.

  • A $300 refundable security deposit is required prior to shipment.

  • Deductions may be taken for damage, loss, late return fees, cleaning charges, extra data usage, or shipping costs.

  • Refunds (minus deductions) are processed within 10 business days of the Equipment’s satisfactory return.

12.4 Condition and Use of Equipment

Lessee agrees to:

  • Use the Equipment in accordance with Starlink policies and all applicable laws.

  • Avoid tampering, modifying, or opening the Equipment.

  • Not resell, rent, assign, or loan the Equipment to any third party.

  • Use the Equipment only in permitted service regions.

12.5 Data Usage

Each rental includes a base data allowance. If the Lessee exceeds their 10GB or 50GB plan limit, additional data must be pre-purchased to continue service.

12.6 Loss, Theft, or Damage

Lessee is fully responsible for Equipment during the rental term.

  • Replacement cost for a full Starlink Mini Rental Kit: C$700, plus rental, data, and shipping fees.

  • HyperLink Inc. determines repair or replacement value at its discretion.

  • Any outstanding balance is due within 7 days of invoicing.

12.7 Rental Insurance (Optional)

If purchased:

  • Covers accidental damage excluding water damage or intentional/willful damage.

  • Damaged items must still be returned.

  • Theft requires an official police report.

  • Does not cover loss or water damage.

12.8 Return of Equipment

Lessee must return the Equipment by the final day of the rental term.

Late Fees:

  • $199.99 for 10GB plan

  • $299.99 for 50GB plan

  • $499.99 for Unlimited plan

Cleaning Fee:

  • $70/hour, minimum 1 hour per device.

Returns must include all accessories and original packaging.
A prepaid return label is provided. Lessee must retain a timestamped tracking receipt.

12.9 No Warranty / Limitation of Liability

Equipment is provided “as is.” HyperLink Inc. does not guarantee internet speed, service uptime, or availability.
HyperLink Inc. is not liable for indirect or consequential damages, including loss of income or data.

12.10 Indemnification

Lessee agrees to indemnify and hold harmless HyperLink Inc. from all claims or damages resulting from:

  • Misuse of Equipment

  • Failure to return Equipment

  • Violation of this Agreement

12.11 Termination

HyperLink Inc. may terminate the rental immediately if the Lessee breaches any term.
Upon termination, Lessee must return the Equipment immediately or pay full replacement value.

12.12 Cancellations

  • Cancellations 48+ hours before shipping/pickup: Full refund minus processing fee.

  • Cancellations within 48 hours: Non-refundable.

  • No credits for early returns.

12.13 Verification Requirements

Lessee must provide identity verification (driver’s licence, passport, etc.).
For security, HyperLink Inc. does not store full credit card details.
